Contents · 9 sections

1. Scope of the Service

1.1.

WaveCom arranges domain registrations and provides registrar services. A domain is registered in the name of the registrant designated by the Customer for the selected period. The right to use a domain arises from the registry entry and the rules of the relevant registry.

1.2.

The registrant is the person in whose name the domain is registered. The person placing the order or paying the invoice does not become the registrant merely by ordering or paying. A Customer acting on behalf of another person must have the necessary authority to represent them.

1.3.

Domain registration does not include web hosting, email or another service unless separately agreed in the order.

2. Top-level domain rules and service providers

2.1.

In addition to these terms, the terms of the registry and actual registrar for the selected top-level domain apply. In the event of a conflict between a mandatory registry rule and a WaveCom term, the registry rule takes precedence, subject to mandatory legal requirements.

Top-level domain Registries, intermediary and terms
.ee WaveCom is a registrar of the Estonian Internet Foundation (EIS). The .ee Domain Regulation and documents referenced in it, including the domain dispute resolution procedure, apply.
.eu WaveCom submits orders directly to EURid. EURid's registration terms, registration data verification procedure, WHOIS terms and dispute resolution rules apply. The registrant must meet EURid's eligibility requirements.
.fi WaveCom is a registrar of the Finnish Transport and Communications Agency Traficom (formerly FICORA). Traficom's .fi domain rules and guidance apply. The registrant is responsible, among other things, for ensuring that the name does not infringe rights in a protected name or trademark.
Other top-level domains WaveCom uses ResellerClub as an intermediary; the contracting partner is P.D.R Solutions (U.S.) LLC (USA). The rules of the selected top-level domain registry and the actual registrar's domain registration agreement and other relevant terms apply. The Customer can review these terms on the page linked above. ICANN rules apply to top-level domains within their scope.
2.2.

Registry rules determine, among other things, permitted names, registrant eligibility, registration periods, data verification, transfer, expiry, restoration and dispute resolution procedures. Time limits and charges are not the same for all top-level domains.

2.3.

For domains covered by ICANN rules, the Customer can review the registrant's rights and responsibilities and ICANN educational materials. The actual registrar can be found using ICANN Lookup.

3. Ordering and completion of operations

3.1.

Before ordering, the Customer checks the spelling of the domain name, registrant details, period and price. An availability search result or acceptance of an order or payment does not reserve the domain. A domain is registered when the entry has been made in the registry. WaveCom sends the Customer an automatic email confirming successful registration.

3.2.

WaveCom submits the operation to the registry after payment and after receiving and checking the necessary data, confirmations and documents. If information or authority to represent is incomplete, the operation may wait until the deficiencies are remedied. Additional registry checks may extend the completion time.

3.3.

If the ordered operation cannot be completed, WaveCom notifies the Customer and refunds the payment received for the unperformed operation. A replacement domain or another operation is not ordered without the Customer's consent.

3.4.

Registration or renewal completed in the registry cannot be reversed, nor can the domain name be renamed. Registration of a new name is a separate order.

4. Registrant details and identity verification

4.1.

The Customer provides accurate and up-to-date registration data and updates it without delay. Depending on the top-level domain, required data may include the names of the registrant and representative, personal identification or registry code, date of birth, nationality or country of location, address, email, telephone number, contact persons and details of authority to represent. Only data necessary for the relevant operation is requested.

4.2.

To register an .ee, .eu or .fi domain, a digitally signed application from the registrant or their authorised representative must be sent to WaveCom in a DigiDoc container. It can be signed using an Estonian ID card, digital ID or e-resident digital ID, Mobile-ID or qualified Smart-ID. The application is sent for signing after the order is placed. The domain is not registered without a properly completed application and the necessary authority to represent. WaveCom checks the signature's validity, the signatory's identity and their authority to represent.

4.3.

An application for the domains referred to in clause 4.2 may also be submitted in a container bearing another country's digital signature if WaveCom can verify the signature's validity and the signatory's identity and the signature meets the relevant registry's requirements. For all top-level domains, the Customer provides any additional information and confirmations required by the registry or registrar by the notified deadline. EURid may require additional verification through My .eu.

4.4.

False data, failure to respond to a verification request or ineligibility to register may result in refusal of registration, suspension of the domain or deletion from the registry under the relevant rules.

5. Renewal and expiry

5.1.

Domains are not renewed automatically. The Customer orders each renewal through WaveCom's self-service portal, accepts the applicable Service Terms and price there, and pays for the order. A consumer Customer gives a separate confirmation with each renewal order for immediate performance and loss of the right of withdrawal after full performance, in accordance with section 7. WaveCom does not create or send a domain renewal invoice on its own initiative without the Customer's renewal order.

5.2.

The Customer submits and pays for the renewal order sufficiently before expiry, allowing for receipt of payment and possible checks. A domain is renewed when its validity period has been extended in the registry.

5.3.

WaveCom generally sends expiry reminders to the Customer's contact email 30, 20, 15, 10 and 5 days before expiry. Additional notices required by the registry or registrar may arrive separately. A reminder is not a renewal order or a demand for payment. The Customer keeps their contact details up to date and also monitors the domain's validity themselves.

5.4.

A domain that is not renewed expires. This may interrupt the website, email and other services dependent on the domain. Renewal or restoration after expiry is possible only within the relevant registry's time limits and terms and may incur an additional charge. The required price is presented before ordering. WaveCom does not guarantee that an expired domain can be restored, that it will later become available or that it can be registered again.

6. Changes and registrar transfer

6.1.

A change of registrant, transfer to another registrar, updating contact details and changing name servers are different operations. The Customer provides the necessary data, authorisations and confirmations for them. Restrictions or waiting periods required by the registry depend on the top-level domain.

6.2.

Authorisation and transfer codes are available to the Customer in WaveCom's self-service portal. The Customer keeps the codes confidential and is responsible for whom they grant access to their account or domain management. A registrar transfer does not in itself guarantee extension of the registration period.

6.3.

For .ee domains, EIS's registrar transfer procedure is followed. WaveCom does not charge for leaving for another registrar. The price of other chargeable operations is disclosed to the Customer before ordering.

7. Immediate performance, withdrawal and refunds

7.1.

For immediate registration or renewal, a consumer Customer selects a separate, initially unticked checkbox when ordering: “I request immediate registration or renewal of the domain and understand that I will lose my right of withdrawal once the operation has been fully performed.” This confirmation is also requested for renewal orders before the operation is performed.

7.2.

Once WaveCom has fully performed the ordered registration or renewal operation on the basis of the consumer's prior express request and acknowledgement, the statutory 14-day right of withdrawal for that operation ends. Performance is confirmed by the operation completed in the registry. Receipt of payment or forwarding of the order alone does not establish full performance.

7.3.

The fee for a fully performed registration or renewal is not refunded merely because the Customer changes their mind, stops using the domain or wants a different name. This exception specifies the application of clause 1.11 of the General Terms. It does not automatically extend to ongoing services ordered together with the domain.

7.4.

This section does not limit the Customer's remedies for WaveCom's breach of contract or statutory rights before the operation is fully performed. Clause 3.3 applies to an unfulfilled order.

8. End of the Service and liability

8.1.

Stopping use of a domain or submitting a termination request in self-service does not cancel an operation already completed in the registry. If the Customer does not order renewal, registration ends through expiry and the relevant registry's procedure. Early deletion takes place only if registry rules permit it and does not in itself create a right to a refund.

8.2.

WaveCom is responsible for proper performance of its contractual obligations. A registry decision, restriction or outage does not release WaveCom from liability for its own breach. Registry procedures and third-party rights are governed by the relevant rules and applicable law.

8.3.

The availability guarantee for web hosting or another Service does not apply to the domain registry service.

9. Processing of personal data

9.1.

WaveCom processes personal data necessary to order, register and manage domains for performance of the contract, compliance with legal obligations and, where justified, on the basis of legitimate interests. Legitimate interests may include fraud prevention, service security and defence of claims. Acceptance of the terms is not general consent to use data for any purpose.

9.2.

Necessary data is transmitted to the registry, registrar and intermediary specified in section 2. Registries and registrars may act as independent controllers in performing their tasks. When registering a domain through ResellerClub, WaveCom and the relevant Newfold contracting partner are independent controllers. Each party is responsible for processing according to its tasks and applicable requirements. Registry rules also determine the information published in public WHOIS or RDAP services.

9.4.

For some top-level domains, necessary registration and contact data may be processed outside the European Union. According to ResellerClub / Newfold privacy information, processing countries may include the USA, India and the Philippines. Applicable data protection measures are used for transfers, including European Commission standard contractual clauses where necessary. The limited exception in clause 10.7 of the General Terms applies. The terms and privacy information of the registries, registrars and intermediary are referenced in sections 2 and 9.3 of these terms. This exception does not cover the entire Customer Portal, billing database, support tickets or hosted content.

9.5.

Data is retained to the extent necessary to perform the contract, comply with applicable legal and registry obligations and defend potential claims. Data subject rights and the procedure for submitting requests are described in WaveCom's General Terms and the relevant recipient's data protection terms.
